By accessing and using the services of Bill Ingram & Grandsons Nursery, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Bill Ingram & Grandsons Nursery provides wholesale plant growing and distribution services. We specialize in trees, shrubs, and ornamental plants for landscaping professionals and garden centers.
We guarantee that all plants are healthy and true to name at the time of delivery. Plants are living organisms and their survival depends on proper care after delivery. We cannot guarantee plant survival after delivery due to factors beyond our control including but not limited to weather conditions, soil conditions, watering practices, and handling.
All orders are subject to availability and confirmation of the order price. Payment terms are net 30 days for established wholesale accounts. New customers may be required to pay in advance or provide credit references.
Delivery dates are estimates and may be subject to change due to weather conditions, plant availability, or other circumstances beyond our control. Risk of loss passes to the buyer upon delivery. Delivery charges are additional and based on distance and order size.
Claims for damaged or incorrect plants must be made within 48 hours of delivery. We reserve the right to inspect any claimed damaged plants. Refunds or replacements will be provided at our discretion for valid claims.
Bill Ingram & Grandsons Nursery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
We shall not be liable for any failure or delay in performance under this agreement which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.
We respect your privacy and are committed to protecting your personal information. We collect only the information necessary to process your orders and provide our services. We do not sell, trade, or otherwise transfer your personal information to third parties without your consent.
All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of Bill Ingram & Grandsons Nursery and is protected by copyright and other intellectual property laws.
These terms and conditions are governed by and construed in accordance with the laws of the State of Florida, and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.
We reserve the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new terms.
